These Terms of Use (“Terms”) govern your access to and use of the Totally Into website, waitlist, and gift-planning products and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. The Services
Totally Into helps shoppers discover and plan gifts for family and recipients by combining your preferences with product information from approved merchants and marketplaces. Features may include waitlist registration, recipient profiles, gift ideas, price and availability checks, and links to third-party checkout pages.
We may change, suspend, or discontinue any part of the Services at any time. We do not guarantee that any feature will remain available or that recommendations will always find eligible products.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Services. You represent that the information you provide is accurate and that you have authority to accept these Terms on behalf of yourself or any organization you represent.
3. Accounts and acceptable use
You are responsible for activity under your account and for keeping credentials secure. You agree not to:
- Use the Services unlawfully or to harm others, including minors whose data you enter only as a parent or guardian planning gifts.
- Attempt to bypass security, scrape the Services without permission, or overload our systems.
- Misrepresent your identity or affiliation with Totally Into or any marketplace.
- Use merchant or marketplace data from the Services in ways prohibited by those platforms’ terms or by applicable law.
- Reverse engineer or misuse third-party APIs integrated with the Services except as expressly permitted.
4. Third-party merchants and marketplaces
Product listings, prices, shipping estimates, and checkout are provided by third-party sellers and platforms. Totally Into is not the seller of record for marketplace items unless we clearly state otherwise. Purchases are between you and the merchant, subject to that merchant’s terms, return policies, and privacy practices.
We validate outbound links against an approved merchant allowlist where applicable, but we do not control third-party sites and are not responsible for their content, availability, or performance.
5. Etsy API and Etsy-related features
When the Services display or use data from the Etsy Open API:
- Listing and shop information may change frequently; displayed Etsy content is refreshed on a schedule consistent with Etsy’s API requirements and may be up to six hours behind Etsy for listings and up to twenty-four hours for other content unless a shorter period is required.
- Etsy members own the content they create on Etsy. We do not claim ownership of Etsy member content.
- If you connect an Etsy seller account via OAuth, you authorize us to access only the data needed for the feature you request, as described in our Privacy Policy.
- You must not use Etsy data obtained through the Services to replace Etsy’s core shopping experience, divert sales from Etsy, or violate Etsy’s API Terms of Use or other Etsy policies.
Etsy’s role is limited to providing the Etsy API as described in Etsy’s terms. Etsy is not responsible for the Services or for disputes arising from your use of the Services.
6. Intellectual property
The Services, including text, graphics, logos, and software, are owned by Totally Into or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial gift planning unless we agree otherwise in writing. You may not copy, modify, distribute, or create derivative works from the Services except as allowed by law.
7. Feedback
If you submit ideas or feedback, you grant us a perpetual, royalty-free license to use it without restriction or compensation to you.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Gift suggestions are informational only. We do not guarantee that items are in stock, that prices are current, that delivery will occur by a particular date, or that gifts will be suitable for every recipient. You are responsible for final purchase decisions.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TOTALLY INTO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR THIRD-PARTY MERCHANT OR MARKETPLACE TRANSACTIONS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Totally Into and its affiliates from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights, including marketplace or merchant terms.
11. Termination
We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. You may stop using the Services at any time. Sections that by their nature should survive (disclaimers, limitation of liability, indemnification, governing law) will survive termination.
12. Disputes and governing law
These Terms are governed by the laws of the State of Louisiana, USA, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply. For users in jurisdictions that require a local forum, you may bring claims in the courts of your country of residence where required by law.

13. Changes
We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. Material changes may be communicated by email or in-product notice where required. Continued use after changes take effect constitutes acceptance.
